Right-to-work checks stay the same until 2021

The checks employers need to carry out on all workers to verify their right to work in the UK will remain the same until 1st January 2021, regardless of whether there is a deal or no deal Brexit, the government has confirmed.

The government guidance also confirms that employers do not need to distinguish between EU, EEA and Swiss citizens who were resident in the UK before or after the UK leaves the EU.

The announcement is important because it confirms that employers don't need to change their recruitment vetting procedures until 2021, whatever the outcome of the current Brexit negotiations. And employers should continue to take care not to discriminate on the grounds of nationality when recruiting workers, for example, by treating EU nationals differently from UK-born applicants.
